RetailTenant provides a subscription-based online platform offering retail and commercial real estate–related data, analytics, insights, and tools (the "Services"). The Services are intended for informational and analytical purposes only.

We may modify, suspend, or discontinue any part of the Services at any time without notice.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

3. Accounts and Registration

To access certain features, you may be required to create an account.

You agree to:

• Maintain the security of your login credentials
• Notify us promptly of any unauthorized use

You are responsible for all activity that occurs under your account.

Payments are processed through third-party payment processors. RetailTenant does not store full payment card information.

• Scrape, copy, reverse engineer, or resell the Services or data
• Interfere with platform security or functionality
• Upload malicious code or attempt unauthorized access
• Misrepresent your identity or affiliation

Data Extraction and Harvesting

The Services provide access to proprietary business intelligence and contact data for use within the platform. Whether by automated means or manually, you agree not to:

• Systematically extract, harvest, download, or compile any substantial portion of the data available through the Services, including business listings, expansion intelligence, and broker or company contact information
• Page through, search, or view records for the purpose of building, supplementing, or maintaining any external database, list, or dataset outside the platform
• Use data obtained from the Services to create, support, or operate a product or service that competes with RetailTenant
• Sell, license, distribute, or otherwise make data obtained from the Services available to any third party

Accessing individual records in the ordinary course of evaluating tenants and conducting outreach for your own properties is expected and permitted. Systematic, exhaustive coverage of markets or result sets for the purpose of copying the underlying data is not, regardless of the pace or method used.

Fair Use and Usage Limits

We may establish and enforce reasonable usage limits (for example, limits on search frequency, result pagination, or the number of contact records viewed or unlocked in a given period) to protect the integrity of the Services. We may monitor usage patterns for compliance with this section.

We may suspend or terminate access for violations of this section, including conduct that, in our reasonable judgment, constitutes systematic extraction or harvesting of data. Fees paid are non-refundable in the event of termination for such violations.

6. Intellectual Property

RetailTenant IP

All content, software, data compilations, analytics, designs, trademarks, and platform functionality are owned by RetailTenant or its licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for internal business purposes only.

User Content

You retain ownership of content you submit. By submitting content, you grant RetailTenant a limited license to use such content solely to provide and improve the Services.

7. Aggregated Data and Analytics

RetailTenant may collect and use aggregated, anonymized, or de-identified data derived from use of the Services for analytics, benchmarking, research, product improvement, and market insights.

Such data does not identify individual users and is owned exclusively by RetailTenant.

8. AI-Assisted Features

RetailTenant may use artificial intelligence and machine learning tools to support analytics, search, summarization, and organizational features.

AI-assisted outputs:

• Are informational only
• May contain inaccuracies
• Should not be relied upon as legal, financial, or investment advice

RetailTenant does not use personal information to train public or third-party AI models.

The Services may integrate with or link to third-party services. RetailTenant is not responsible for third-party content, availability, or practices.

Your use of third-party services is governed by their respective terms.

11. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms.

Upon termination:

• Your right to access the Services ceases
• Certain provisions survive (including IP, disclaimers, limitations, and governing law)
